Israeli court freezes evacuation order against Jerusalem family

JERUSALEM (Ma'an) -- The Israeli Magistrate Court of Jerusalem ordered the freeze of an evacuation order against a Palestinian family from the Sheikh Jarrah neighborhood of occupied East Jerusalem, on Monday.

Muhammad Sabbagh told Ma’an that the Israeli court decided to freeze the evacuation order against his family, until the appeal presented by the family and the ownership of the land, on which the building is located, are observed by the court.

The family was ordered to pay 35,000 Israeli shekels to the court for the freeze.

In 2012, the Sabbagh family had filed a law suit at the Israeli District Court in Jerusalem against Israeli settlers' claim that they own the land in question in Sheikh Jarrah.

The Sabbagh family had provided the court with evidence proving ownership of the land and that Israeli setters’ land registration process done in 1972 was illegal and not proper, therefore, their claim of ownership was null and void, the court nevertheless ruled in favor of the settlers on claim that the statute of action in the case has expired.

The family, through its lawyers, appealed the ruling to the High Court on November 15, 2018, which rejected the appeal and upheld the District Court’s decision.
